{"id":23769,"date":"2022-03-10T11:04:02","date_gmt":"2022-03-10T11:04:02","guid":{"rendered":"https:\/\/fishingmaniadev.co.za\/fire-services\/?page_id=23769"},"modified":"2023-04-27T12:55:56","modified_gmt":"2023-04-27T12:55:56","slug":"terms-conditions","status":"publish","type":"page","link":"https:\/\/www.www.admin.fire-service-app.com\/site\/","title":{"rendered":"Terms &#038; Conditions"},"content":{"rendered":"<p>TERMS AND CONDITIONS<\/p>\n<p>By accepting these terms and conditions. the signatory acknowledges that these terms and conditions are applicable to call out or service charges done by Fire Services App (Pty) Ltd (herein after referred to as FSA) as Instructed by the signatory or the entity duly represented by the signatory<\/p>\n<ol>\n<li>UNDERTAKING OF Fire Services App (Pty) Ltd:\n<ul>\n<li>That FSA Will provide me with a maintenance agreement for call out or Service costs before commencing with the maintenance agreement.<\/li>\n<li>That FSA reserves the right not to commence with any work unless the maintenance agreement has been signed and accepted by all parties.<\/li>\n<li>FSA Will not charge the company a price for services, or goods and services that exceed the maintenance agreement, unless after providing the estimate of work not included in the maintenance agreement. FSA will submit the quote for additional cost via the Fire Services App. On approval of the quote via the Fire Service App the client accepts cost indicated on the quote.<\/li>\n<li>FSA will perform callouts or services on the agreed date and at the agreed time as per the app or within a reasonable time informed by the FSA Admin.<\/li>\n<li>FSA undertakes to conduct the work required subject to the applicable terms and conditions in a<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<p>skilful manner.<\/p>\n<ul>\n<li>FSA will not be liable for any defects If it will be unreasonable to expect FSA to discover the unsafe product flaw. failure, defect, or hazard regarding the equipment installed.<\/li>\n<li>FSA will not be liable for any defects Inherent to the Installation of equipment in Instances where such installation or system was not designed. installed or maintained by FSA unless FSA IS duly appointed by means of a contractual agreement to supervise, repair amend, change, or maintain such installation or system.<\/li>\n<\/ul>\n<h4>2. LIABILITY FOR PAYMENT<\/h4>\n<p>2.1 The Company undertakes liability for payment of a call out fee or service as determined by the maintenance agreement with FSA.<\/p>\n<p>2.2\u00a0\u00a0The Company acknowledges that a call out logged on FSA constitutes an undertaking to be liable for the call out fee Irrespective if any repairs had to be provided by FSA or not.<\/p>\n<p>2.3 The Company further undertakes liability for payment of all amounts payable to FSA In respect of services rendered and parts provided during a call out in terms of the maintenance agreement provided after the work is completed<\/p>\n<p>2.4 Additional charges for undue or unreasonable delays caused by the client between arrival at the site \/ premises and the actual commencement of the work<\/p>\n<ul>\n<li>5 Payment of an invoice can be made in cash or EFT to the allocated bank account of FSA\n<ul>\n<li>Payments of accounts must be made on date of acceptance thereof<\/li>\n<li>The Company shall be liable for:\n<ul>\n<li>Any bank charges levied against EFT In the event that the bank declined any method of payment made by the company,<\/li>\n<li>All legal costs incurred by FSA in recovering any amount due and payable, calculated on an attorney and own client scale, Including tracing fees and collection commission.<\/li>\n<li>On completion of a callout or service the appointed staff member for the site, signing the job card or service certificate thereby acknowledge completion of the work conducted, Should the relevant staff member not be available they accept the sign off by a third party as per the app conditions, on the face of It of any amount due by the company.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h4>3.\u00a0EXCLUSION OF LIABILITY<\/h4>\n<p>3.1 FSA and its employees shall not be liable for, and we hereby indemnify FSA and its employees, from all liability for any loss. injury and \/ or damage of whatsoever nature to my property arising. either directly or indirectly, out of any omission, delict or in contract by MFS of its employees.<\/p>\n<h4>4.
